Throughout history, transgender people of color have had a place of honor in many indigenous cultures around the world. This changed in many places, however, as European colonizers began forcing indigenous people to follow white social norms. These include anti-Blackness, Christianity and a gender binary that reduced gender to just man and woman. Colonizers presumed that being cisgender, or having a gender identity that is congruent with gender assigned at birth, was the only acceptable norm. For trans people who refused or were unable to conform, colonial societies often used racism and cissexism, or behaviors and beliefs that assume the inferiority of trans people, to invalidate their existence, limit their access to resources and threaten their well-being. In a majority of U.S. states, bills aiming to restrict who can compete in women’s sports at public institutions have either been signed into law or are working their way through state legislatures. Caught up in this political point-scoring are real people – both trans athletes who want to participate in competitive sports and those competing against them. As a professor of ethics and public policy, I spend much of my time thinking about the role of the law in protecting the rights of individuals, especially when the rights of some people appear to conflict with the rights of others. The Latest Battleground Over Transgender Rights – High School Sports

This year, 20 states proposed to ban transgender girls – meaning those assigned male at birth but who live and identify as girls – from competing on girls interscholastic sports teams. The only bill to pass was in Idaho. That law bars transgender athletes from participating in high school and college sports. It also authorizes “sex testing” of athletes through genital exams and genetic and hormone testing. The ACLU is challenging the law, arguing that it violates civil rights, and a federal court has delayed its implementation.
